Richard Falk, the UN Human Rights Council’s permanent investigator of alleged Israeli violations, is calling for a “legitimacy war” against Israel, with boycotts, divestment and sanctions. His reports portray the Hamas terrorist organization as peaceful. Falk is also one of the world’s leading supporters of the conspiracy theory that the September 11, 2001 terrorist attacks were an “inside job” perpetrated by the US government.

Dear President Obama,

When the United States joined the UN Human Rights Council last year as one of its 47 voting members, your Administration pledged it would “engage in the work of improving the U.N. human rights system to advance the vision of the U.N. Declaration on Human Rights.”

To achieve this goal, I urge you to condemn the offensive behavior and abuse of mandate by Richard Falk, the council’s permanent investigator of alleged Israeli human rights violations, and to call for his immediate removal.

Please note:

1. Mr. Falk has used his UN imprimatur to promote the conspiracy theory that the September 11, 2001 terrorist attacks were perpetrated by the U.S. government. The effect is to deny and excuse the terrorism committed by Osama Bin Laden and Al Qaeda. In his November 2008 article entitled “9/11: More than meets the eye”—signed in his UN capacity—Falk implied that the crimes were committed by “the established elites of the American governmental structure.”  Falk’s article praises the work of David Ray Griffin, whose notorious books argue that the World Trade Center was not attacked by terrorists, but was rather “an inside job.”  Falk has played a key role in promoting Griffin’s conspiracy tracts.

2. As he does in his most recent report, Mr. Falk has used his UN position to legitimize the Hamas terrorist group, which he portrays as a peaceful organization.  In fact, as the Palestinian Ma’an news reported in March, Falk is so extreme that even the Palestinian Authority asked him to quit, on account of Falk being “a partisan of Hamas.”

3.  Mr. Falk’s latest report calls for a “legitimacy war” against Israel — a global campaign of boycott, divestment and sanctions.  This contravenes the basic rights due Israel as a fully accredited member state under the United Nations Charter, and wrongly demonizes a country that is the Middle East’s only democracy and America’s strongest friend and ally.

Mr. Falk's actions breach his UN mandate and his obligations under UNHRC Resolution 5/2 to uphold the highest standards of integrity, probity, impartiality, equity, and good faith.

I therefore urge the U.S., as a leading member of the UN Human Rights Council, to act immediately to end Mr. Falk’s abuse of human rights principles.
